Death Wish

My father is dying. He secured an attorney to handle his personal belongings and final details of his death (i.e., where he wants to be buried, etc.). He wanted to place his sister and myself in charge of his final plans, as his wife is disabled and will not be able to carry out his wishes. The lawyer told us it didn't matter what he wanted-the wife would have final say in the matter. Is this true even if my father is able to make these decisions for himself at this time?

Re: Death Wish

If your father is mentally competent, he has the right and capability to make a Last Will and Testament and, for his lifetime, a Durable Power of Attorney for Financial Affairs and a Durable Power of Attorney for Health Care. You should ask the lawyer to prepare these documents for your father to sign.
