Performance Rights

A recording was made of our live performance in Iowa last year. The recording is coming out as my live cd. I paid the musicians for the performance that evening. Do I owe them any money for the CD when it comes out?

You may or may not depending on the terms of your agreement, if any, with the musicians about whether they were employees and whether the performance was a work for hire.

This question indicates you need to employ a copyright lawyer to write you a copyright assignment agreement to have musicians sign before they perform in your band. Also, for special performances which are to be taped, you should have a special written work for hire agreement.

I can help you with those, or any experienced local copyright lawyer in your area should be able to do them, as most experienced copyright lawyers should know the law on work for hire.
