American/Brazilian couple married in WI about to divorce

i am asking for a friend...she is an american citizen (born here, lived in brazil, then moved back here). she married her brazilian husband ~3 years ago by going to a wisconsin court house and signing papers. she is seeking a divorce now and i want to find out the following:

1. are there any specific legal issues that she should be careful of since he is a brazilian? he has NEVER lived in the USA at any point of the marriage.

2. he promised her he would move here after they got married but never did. is that grounds for an anullment?

I dont have enough facts with your question to give a complete answer or help her sufficiently.

However, I doubt if she could get an annullment if married for 3 years. If he has been a resident of Wisconin and her county for more than the required period of time, then she can file for divorce.
