Child Security and Safety

What type of legal action does a father have in regards to his son when his wife has a mental illness where the safety of the son is in questions. The husband/father does not want a divorce, buts wants to make sure that the son is safe from his mother untill the illness is gone and that any decission with respect to the son goes through him for the safety of his son. The wife mental illness has put the saftey of the son in question when they are together. What can the father do to make sure the safety of his son is in tack.

Hello, thanks for the email. There are a number of things that can be done legally to protect the boy. However, which is best depends on the situation and I need more facts to determine that. I assume the father and mother are separated. Petitions can be brought in Juvenile court that can protect the child. This can pertain to visitation and placement. The procedures are not particularly expensive, but would involve some drafting of documents and a couple court appearances. I wish I could be more helpful, but do not want to lead you astray with the wrong suggestion, if that is what would happen without enough facts. Suffice it to say, there are steps that can be taken to help with the safety of the son.
