Legal Question in Family Law in Wisconsin

child support issue

My ex-wife is claiming that my wife should be helping to support our son because there are two incomes here. We are paying for medical insurance and all medical bills not covered by ins. We are, also, paying for all school expenses, clothing, food for lunches and any other expenses. She says that we should also be sending money for pleasure things that she wants to do with him. We have equal visitation. Actually, we probably have him more than half because of her being in volleyball and baseball.

When school starts we will have him before and after school, too.

Re: child support issue

Your state's administrative rules probably differ from mine, so take this with a grain of salt. Generally speaking, a parent's child support obligation is meant to meet that parent's share of the child's living expenses. It would not necessarily cover ballet, computer camp, new basketball shoes, unless those were somehow factored into the calculation under "extraordinary expenses." I'm guessing that your insurance premium is already recognized in the calculation. Lots of folks make lots of claims. You can usually call your state child support enforcement agency to get information on what child support is supposed to cover. The child's mother pays for the pleasure things she wants to do with your son. If she believes the child support amount is not fair, she can probably ask the state enforcement division to recalculate and modify if appropriate. Your present wife has no legal obligation to support her step-child.
