Child Support

If there was no paternity test done for my husband, approx 8yrs ago... and he signed off that he was the father, if now proven that he is not the father, does he have any legal right to change the court ruling to pay child support? Also, would any of the money paid for the child support be able to be recovered? If he is the father... is there any way to sign off rights to the child & not pay child support? Also, we have been trying to contact the mother for over 4mos., with a court order of visitation... now after paying the mother over $10,000 for past due amounts... we have been unable to set up visitation & she only wants the child to have ''one on one'' time with the father, not myself (his wife) or our 2 children... is there anything legally that we can do?

Hello, this is not an easy case legally or factually to give you much input on. You will

have to double check anything I say with an attorney of your choice, and not rely upon this quick comment as your legal advice. If your husband can prove he is not the father, then likely he could sign off rights and end child support. It may be difficult to recover past paid child support because he did admit to being the father up to this point in time. Usually, the parent that has visitation is not limited to one on one visits. If visitation is being limited, you may be able to go to court to get an order to get visitation clarified or enforced.
