what are the guidelines for a father to be able to claim a child on their income tax returns?

If a court allows you to claim the child in a court order, you can do so. If not, such determinations are made by the IRS code which, generally, allows the parent that provides more than half of the care for the child to claim the child. In other words, the parent with primary placement.
