Child Support-parent quiting job to attend school

I have custody of my five year old child. The Father and I, however where never married. He was ordered to pay a set amount of child support of a set amount each month. He is a 34, is gainfully employeed, owns rental property, and a car that is worth substantial amount of money. He is planning on quitting his job to ''attend Law school''. When the Judge makes his new judgement for child support, does he just automatcally reduce it, or, does he look at his earning potential he already has? Also, if he is in Law school and does not have any employment will he be required to sell his other property to pay child support?

In most cases, the Court will not reduce child support . It is likely to be based on his earning capacity since that is in the best interest of the child.
