Children failing school-No parental supervision
My two children live with their mother in WI as if they are roomates. She is not a fit parent. I live in KY and our original order gives us joint physical custody. My children are failing school (middle/highschool) and after speaking with their teachers it is due to the fact they are not turning in any assignments. They have no parental supervision due to my ex never being home and they are out all hours of the night. The 15 year old is drinking and partying. My ex does not care. All she cares about is the cs. She is always out partying or at her boyfriend's. I know my wife and I could provide a stable home for them and they would get better grades if they lived with us. I am worried about their future if they do not have an education. Even my ex's own brother and mother feel the kids would be better off here with me. Would I be waisting my time and money in pursuing custody? Althought my kids love me, I know they would not want to live here and would tell the judge that because they would have to live in a house with rules. I have been told it is almost impossible to take custody away from a mom unless I can prove drug/physical abuse but I am very worried for their safety and future.

yours is not a question that has an answer that can be stated...it is very fact dependent and as facts are discovered, the value of your moving for custody will change. You need to do something, however, if you truely feel that she is not a fit parent. Of course, having people come to KY to testify may be difficult and you would have to do alot of legwork in WI to get records, etc to submit. No case is predictable and there is no grounded answer that you can get from an attorney as whether you should or shouldn't.
