Legal Question in Family Law in Wisconsin

Division of debt accrued during marriage

Hello. I'm sure my marriage is heading towards divorce. In Wisconsin there is the 50/50 law. Are any and all debts on my spouses charge cards half my debt? How about any debts brought into the marriage by either of us? i.e., college loans, medical debts. When are all accounts frozen, meaning any new debt will be the sole responsibility of the one who creates it? Thank you for any help.

Re: Division of debt accrued during marriage

Hello,

Yes, assets and debts that came about during marriage are 50/50 regardless of whose name they are in. And assets and debts that someone brings into the marriage can be that person's separate property. After a divorce is filed, a hearing can be arranged at which the judge rules that any new debts are the person who get them, and also assigns who is going to pay for what debts that are present now. Best wishes, Mark J. Mahoney
