Legal Question in Family Law in Wisconsin

I am divorced and have full custody and placement of two children. Son is almost 17 and has been asking me this last year why he has to have his dads last name if he is no longer a part of our lives. I have been divorced for almost 7 years and my ex has had no contact, visitation and paid no child support. Can i legally give my son and his almost 13yr old sister my last name? How can i do this?

No.

The court would require a signed release by both parents to do so.

They can petition the court once they are 18.
