Legal Question in Family Law in Wisconsin
estranged husband not cooperating
I asked for a divorce in September, my estranged husband moved out of state quickly, and took everything with him. He has hired a lawyer in this state, and I have not. We had only been married for 4 months when I wanted the divorce. He has not responded to anything his lawyer has sent him, and he did not show up for court in March. His lawyer had NOTHING signed by him. What can I do to get this moving along?? I have already called the clerk of courts and his lawyer several times a week since March, and I keep getting the run-around.

I would strongly recomend that you obtain
an attorney as soon as possible. Your situation
is not especially unusual, and there are
ways of getting your divorce without the
husband ever showing up, provided that he has
been properly served. These proceedures, however,
are complex and more than the average person can handle
on their own without legal training.

You need to get a hold of a lawyer, paralegal, or log on to www.wisconsinforms.com to get some forms to get a courtdate. From what you have described you need a default date set in front of the judge. You also need forms. A lawyer you retain will tell you which ones. At my site download the free forms: A13, A132, A21P, A28, A11, A112, and fill 'em out and have a lawyer review them and then file them in court. Ask the clerk to give you a default date (if he has not filed a response) or a pre-trial date if he has filed a response. If he fails to show up, whala! the judge should give you a default date and the requests in your A21P.
