Here is the scenario. I am divorced with two great Kids. Divorce decree says I pay half and Ex pays half of ''out of pocket expenses'' for Kids health care. My employer contributes $1200 to my HSA. I think (hope) health bills should work like this. After bills are paid by my insurance carrier we split. (I can pay cash or use my HSA. What ever I choose.)

Ex says, after insurance carrier pays, then use my HSA. If any remains we split.

Guess the legal question is what is ''out of pocket.'' Is it what remains after insurance carrier pays (I hope) or after insurance carrier and my HSA pays? (She hopes)

I would say that it is whatever expenses are not, in the end, covered by any insurance benefits either of you have.
