Fathers Custudy Rights?

I am a 18 year old, unmarried mother. My childs father is on the birth certificate. My son also shares both of our last names, which is also documented on his birth certificate. Does the father still need to get a paternity test if he wants full custody of the child?

Yes, I would suggest that a paternity petition be filed immediately. This will not only establish fully enforceable custody/visitation rights for both of you, but it will also allow you to get a fully enforceable court order for child support.
