Who keeps the house?

I am getting ready to file for a divorce, but before I do I want to make sure my children's future is going to be ok. My question is that when we purchased our home, my husband was still an illegal alien, since then he has become a legal resident, when the house was bought, it was only placed in my name, and approved under my credit, income, etc. I have been the one making monthly mortgage payments, and have proof that as I get paid from my employer the mortgage payment is deducted from my own checking account. He has never given me a cent towards these mortgage payments. I heard though that even though only one of the spouse is on the mortgage, because we're married, 50% belongs to him? IS this true? thank you so much for your help.

Anything that ypou purchased during your marriage is a marital asset. That means it is geerally divided in a divorce. It does not matter whose name teh asset is in.
