Legal Question in Family Law in Wisconsin

Maintenance Payments time frame

I'm in the middle of a divorce, I was married for 28 years to my wife. We are trying to work with the same lawyer since we have few assets mostly bill and a small 401k on both sides. The lawyer is suggesting indefinate support. I feel a time frame needs to be set. I make about 10K more than her, She has a degree and I don't. She workes part time and I feel she should work full time which would make us equal in our wages. How should I proceed and what can I expect from 28 yr marriage as far as maintence payments time frame to my wife, according to WI law.

Re: Maintenance Payments time frame

First off, GET SEPARATE LEGAL COUNSEL FOR EACH OF YOU. The attorney you have been dealing with has arguably corrupted the attorney-client relationship between himself and both of you by apparently working for both of you. I just tried a divorce in Waukesha County where they had been married for almost as long as you have. I represent the husband. They are both in their late 40s, no kids, he has a 401(k) and pension. They both work, though he earns far more than she does. The judge basically split everything down the middle and awarded her eight years of maintenance at, if I recall correctly at this moment, $1,5000 a month. You should not have to pay your soon-to-be-ex permanent, lifetime maintenance if she has any education beyond a highschool diploma and some work history that she can rely on to support a reasonable lifestyle. You need to call me ASAP!
