Marital property, Right to know.

Can a spouse who is separated by choice and not legally go out and purchase a home without the other spouse's consent,and or signing of any paperwork?

The short answer is yes. The problem is getting a title company to insure title without the spouse signing off on the property. All earnings after separation, whether legal or factual, are separate property. Therefore, the answer is yes, but in practice there are many more complications, such as where the money to purchase the home is coming from. Good Luck, Pat McCrary
