Morgage/Divorce

My spouse and I are going through a divorce. Our house has a second morgage, are both parties resposible for the debt? One spouse is not living in the house.

Greetings,

As a general rule, all property acqired by a couple during marriage, and all debt, is 50/50 owned. So that includes your house and mortgage. It does not even usually matter whose name is on the mortgage or the house, it is 50/50. However, there may be more to this than I know about, so dont take this as a legal opinion for your case, just as general information.
