Legal Question in Family Law in Wisconsin
Paternity Rights of Father in WI
I am unable to find a job at my age that will support my son and I who is 6 mos old. The father has a well paying job and is threatening to take full custody. I have been denied of all assistance for my son. I am looking to join the military. Can my son be taken away from me even though I am his primary caregiver? My mother offered to become a legal guardian while I am gone, would that be the best route to take as to having someone in my family represent me? I am also wondering how to prove that he is not a good father to my son. I know he doesn't take care of him, but I am not sure how to prove it. He overfeeds, neglects, and takes care of him at convenience. Those are all difficult things to prove. I'd appreciate your help on this. I need to protect my son and take care of myself at the same time.

You certainlyhave a defense related to self defense. However, that is an issue that must be argued to a court or discussed with a prosecutor.
I would suggest that you should hire counsel to avoid having this charge appear on your record.
