Legal Question in Family Law in Wisconsin
reducing child support due to unemployment
My husband is ordered to pay $595/mo for child support plus 1/3 of daycare costs during June, july, & August for his daughter from a previous marriage. We have visitation on Tuesdays and Thursdays and alternate weekends. He recently lost his job due to layoffs within his company. We have a daughter also and are struggling to make ends meet while he is unemployed. Will the courts consider reducing the support while he searches for employment or is it a lost cause?

Re: reducing child support due to unemployment
Yes, this would be a substantial change of circumstances. Sometimes one can get the child support department to make a change informally and temporarily by proving that the payer is receiving unemployment compensation. Immediately contact the child support department in your county and see if they have such a policy.
Otherwise you must file a motion with the court and the support cannot be changed retroactively -- the change can not go into effect until you serve the motion on the person receiving the child support.
