Reusing a past divorced name

My husband's first wife just divorced her second husband. Instead of changing her name back to her maiden name, or keeping the ex-husband's name, she went back to my husband's last name. Afer my husband's divorce, the courts asked his ex whether she wanted to keep her married name and she choose not to. Can she legally take her ex-husband's name again?

Chapter 767.20 reads: The court...shall allow either spouse, upon request, to resume a former legal surname, if any.
