Legal Question in Family Law in Wisconsin

What are my rights to spend time with my child.

I am a father of a child of 2.5 years.

Mother lives 130 mile away now.

I filed with the local court for a hearing on Custody and Placement. We were instructed to go to parenting class. Then mediation. She never showed up. No call or anything.

Her lawyer does have a motion pending to have the procedings moved to her county. But that will not be heard until March. This was sumitted after the order for mediation.

Since her move she will not let me take my child out of her home. Not even for a couple hours. I have driven back and fourth every week twice a week since her move in June to spend time with my son. Is there anything I can do to be able to spend time with my son outside of her home and time with my family? Or do I have to wait until the motion to move hearing? And after that what do I do? There was no abuse or problems with either one of us. So that is not an issue. She wants a guardian iliem appointed and full custody of my child according to her lawywers request for movement. (Stall tatic???)I am asking for joint custody, placement with her.

Help please.

Hello, thanks for the note. You have the right to reasonable placement and visits with your son. However, in the worse case scenario you have to travel up there every other weekend to see him. Another possibility is that you fight the battle and end up with custody and placement. That would be costly and time consuming and uncertain as to whether you would win or not. You should be able to get visits outside the home, even longer visits during the summer. You might not be able to do much until the hearing date. Good luck, let me know if you need help.
