Legal Question in Family Law in Wisconsin

spousal maintance

this is for my brother in law. how long does he have to pay spousal maintance its been 11 years, both kids are over 18 and gone. does he need a lawyer or can he do it him self? the divorce papers doesnt state a cut off point. thank-you

Maintenance can be set by divorce judgment to be fixed in amount and duration and cannot be changed; or it can be set as limited term maintenance which can be changed if done so prior to the expiration of the set term; or it can be general that does not technically expire until death.

If it is of the latter 2 types, then it can change if there has been a substantial change of circumstances. That determination is too complex for an answer here. Although it is difficult to imagine that it could be done without the assistance of an attorney.

However, having said that many people have represented themselves in court in a variety of ways and situations and some of them have been successful. Whether any particular individual can do that for himself or herself is also too complex to answer here. That, too, should be discussed with an attorney. Too often an individual simply doesn't know what he doesn't know without the advice of counsel.
