Legal Question in Family Law in Wisconsin

getting temporary custody of 14yr old by non relative

My Family would like to get cutody of a 14yr old. He is a non relative. His mother is a supposed recovering herion addict, father is in jail. He is living with grandmother and has been for two years, until father was put in jail. The child wants to live with me, and grandmother and father want the child with me. The child would stay in same area as now. He hasn't lived with mother in 6 years. Is this possible to do? How hard would it be? what first steps do I take to begin the process?

Hello,

See an attorney. The social services agency will also be able to assist. A CHIPS petition would be considered. That is a way for the government to take custody, but placement is another matter. I would not rule out you as an option, but that depends on the facts and a close evaluation of alternatives. I dont have all the facts, not so much of you, but of the juvenile and his family. The social service agency in your county might be able to get you started -- or you can start with getting a couple legal opinions from lawyers in your area. If you go to Social Services, you will want the Child Services area. Best wishes, Mark J. Mahoney
