Theft by fraud
If my wife has been stealing our house payments and not paying the mortgage and the house gets forclosed, can she be held laible for my losses? and is there a way to get the house back?

If you were to file for a divorce or a legal separation, you could claim that your spouse dissipated marital assets and seek to have her compensate you in the divorce property settlement.
Unfortunately, if your home has fallen into foreclosure, there is no easy way to get it back. The creditor may rely on their contract regardless of who is responsible for failing to pay the bills.
