Legal Question in Medical Leave in Wisconsin
Being harrased at work
I recently have gone through some depression and panic attacks that required me to talk some time off work. I even handed in paper work for the FMLA. Every since that paper was turned in my boss has coming up with ways to leave his office. While being treated with medicine and seeing a therapist he comes up with ways to tell me that my work performance is bad. We had several meetings about my work habits and how they have gone done hill since my illness. I have two meetings with Human resources stating that people are making complants about me but yet they won't tell me who. Also my boss acussed me of doing something that I know I did not do. I hear my boss say that he did not like me and he wishes that I would disappear. After that happened I did report it to Human Resources. I told them do you know what its like to go to work knowing that you boss doesn't like you and he his making up lies about my work perfomance to get me to quit. I was a good hard worker before all the paper work was handed in. And when he does accusse me of something he will wait for days to say anything. He will go to the superviser who will keep notes for that month of all my wrong doings instead of confronting me right away. What should I do?

Re: Being harrased at work
It is unlawful under the FMLA for your employer to retaliate against you for taking leave under the FMLA. A court will examine to determine whether the conditions you are currently experiencing are due to the leave or some other reason. If it is due to the leave, then the law will provide you with a remedy in the event you suffer an adverse job action.
