What is the smallest increment of time allowed to use FMLA or WFMLA?

Under federal law, the smallest increment is going to be generally the smallest pay unit that you have with your employer. Typically, this is 15 minute increments, but theoretically it could be 1 minute increments. The only real clear answer is that it absolutely can be less than full day increments.

You also may be protected by state laws. In order to determine what rights you may have under state law, you would not to consult with an attorney in your state.
