Broken Engagement

My son broke his engagement and has asked for the engagement ring to be returned. She refuses. Does he have a right to the ring back? It isn't even paid for yet.

Sorry, this is a family law question, not litigation. There is a good argument that the ring was conditioned on marriage therefore if marriage did not occur, the ring should be returned.
