Custody of a dog
I purchased a puppy for my girlfriend and myself in Jan. of 1999. She lived in Minn. at the time and I lived in Wi. At the time I was planning to move there in May so the dog stayed with her most of the time but I would take him maybe one week a month untill i moved there in May. I lived there all summer and in August the dog moved back to Wi. with me. She moved in with me in oct. and stayed untill Jan. when we broke up. She has a letter from me written at a time when we thought the split was temporary stating that the dog can live with her. She currently lives at an apartment where she can not have dogs as stated in the lease, although her name is not on the lease it is her place of residency and she recieves her mail there. The dog has been living with me since she left. She is currently talking to an attorney about getting custody of the dog and giving him to her parents so in the future when she moves she can have him. I obviously want to keep the dog also. Will she be able to take any legal action in order to get custody of the Dog?

One can always litigate for the return of property,
which is the way a pet, unfortunately, is regarded by
the law. If no resolution is worked out, the court
can order sale jointly owned property and division
of the proceeds. You may have gifted away your ownership
rights, depending upon what that letter says. Have
you considered alternating custody?
