Legal Question in Civil Litigation in Wisconsin
How do I get a felony expunged from my record in Wisconsin?
1 Answer from Attorneys
Expungement of felony convictions in WI is nearly impossible; there is simply no legal authority for judges to do it. One is far better off fighting the case at the outset since changing anything after it is over is just not an option, unless some legal error occurred during your proceedings which might allow you to collaterally attack the conviction. WI governors, however, as well as United States Presidents, do have authority to grant "executive clemency," as pardons, on felony convictions; a power which is rarely used. When it is used, it is generally guided by political considerations such rewarding someone who has assisted the governor or president in a campaign, or due to a public outcry for the correction of an injustice. A successful applicant nearly always has lead an exemplary, crime free life for at least a decade or two since the conviction. You should schedule a consultation with an experienced criminal lawyer if you wish to explore these possibilities.
