Legal Question in Immigration Law in Wisconsin

Amending the Petition filed for GreenCard

I am on H1 Visa here.

I married 2 years back and my wife is here on H4 visa.

My wife's parents are expected to become citizen in the next 11 months.

They filed a immigration petition for my wife when she was under 21 years and was not married then.

The Question is------

Can his father include my name now in the petition already filed ? or he has to file a new petition including both our names.

Or is there any other way to get the process speed up as both of us are already here.

Can u advise me on this whats the best way to go from here.

Thanks

Re: Amending the Petition filed for GreenCard

Sorry, your father-in-law can't sponsor you. As you probably know, as the married daughter of a US citizen your wife falls under the 3rd Preference or category for family based immigration. People in that preference who "got in line" 0n 5/8/96 are now being processed. There is no way to know how many people there are in front of you in the line, but there wouldn't be a line if there were enough visas in that preference for everybody who qualified. I'd say even your wife will not get to the front of the line for ten years or more. You will have to pursue lawful permanent residencxe through your employment.
