Legal Question in Insurance Law in Wisconsin

Auto Accident

Hello,

I had a couple of questions regarding a car accident I was in on Dec. 24 in Wisconsin. A driver coming in my direction lost control of his vehicle due to slippery roads (he was going too fast) and hit the back driver's side of my car. The police responded to my call and issued him a ticket for driving too fast for conditions. Unfortunately for me, he doesn't have insurance, and I don't carry collision on this car. My insurance company, Progressive, says there is nothing they can do. Is my best bet to take this to small claims court after getting an estimate? Are there other steps to follow or things I need to do? I have never been in an accident before and am really not sure what to do. Please help, and if you can't I would really appreciate if you could direct me to someone who could help. Thank you!

Re: Auto Accident

Get 2-3 estimates and take the other driver to small claims court. If your property damage is too high for small claims court, then you may have to hire an attorney and sue the driver in district court. Get all the documentation that you can about the fact that the other driver caused the accident and the damages to your vehicle. Those are the steps that you should take. If you or any passenger suffered an injury, then that raises additional issues and I would be happy to discuss those with you. Happy Holidays and I am sorry that this has happened to you.

I hope that I have helped, answered all of your questions, and that I have provided you with useful information. Please contact me if I have not answered all of your questions.

Please be aware that my answer is not legal advice, it is merely information. You and I have not entered into an attorney/client relationship. The only way that I am legally responsible for your legal rights is if you have signed a written retainer agreement with my law firm.
