auto accident settlement reimbursement to employer paid health insurance
i was in an accident and have been offered a settlement but my health insurance wants a part of it. can this happen? I'm covered in full by my health insurance and by my spouse's employer paid insurance also. the insurance co. has placed a lien on the settlement. what is the wisconsin law on this. i won't settle until i find out if the health insurance company has a right to part of the settlement.

Yes they have a legal right to do this assuming that your health insurance contract gives them a subrogation or lien right. Please discuss this with your current attorney and have your attorney investigate the lien language. This is a common occurrence in these cases.
