Legal Question in Insurance Law in Wisconsin
Long term disability and Social Security
I received long term disability from Northwestern Mutual through my employer. I had a SS hearing and was found to be disabled. I was sent a check for back SS payments of which most of it went to Northwestern to pay back the long term disability. I have a 9yr old and she to was given a back log payment. Northwestern says if there is any award given to a dependent they are entitled to a certain percentage. They said that this is stated in the long term disability policy. I wrote a letter to my employer and received an answer of ''the situation is between you and the insurance company''. My daughter never received any money from Northwestern so therefore they should not be entitled to any of hers. They are deducting $100 per month out of the difference they would pay me that I do not get from SS. Could you please tell me what my recourse would be with regard to the above. Thank you.--name removed--Lay
