Legal Question in Insurance Law in Wisconsin
Title Company Paid Off Wrong Mortgage
I own my home and recently sold a 4 unit - both properties were mortgaged through the same mortgage company. Upon sale of the 4 unit the title insurance company erroneously paid off the wrong mortgage. I now own my personal home lien free and the mortgage secures a property I no longer own. The new buyer is obviously insured against title defects. Am I required to pay the mortgage which should have been paid at closing?

Unfortunately, this is outside my specific area of expertise. You should try to get an opinion from a real estate attorney.
