Legal Question in Intellectual Property in Wisconsin

limits of word marks

I am opening a retail bridal shop called ''A Savvy Bride, LLC'' and there is a trademark registered for ''savvi formalwear'' (serial number 78487528) which is a tuxedo rental.

Does that trademark prohibit me from using the word savvy? could I be sued for the use of the word even though its spelled differently?

Re: limits of word marks

what you are asking is "does a likelihood of confusion exist"...this is really a question in which the trademark office and/or court wold have to decide...so i cannot answer this question except to give an opinion...the farther away from the mark "savvi formalwear" you are the less likely you are to face a problem...also, you can always be sued even if your mark is nothing like savvi formalwear...they could sue you if your name was "ABC formalwear"...that doesnt mean they will win...and defending an action is never fun...so i cannot predict how savvi formalwear would react. justin lampel
