Legal Question in Intellectual Property in Wisconsin
I signed a contract stating "Model Release. The CLIENT & SUbject hereby grant JBP and its legal representatives and assigns the irrevocable and unresticted right to use and publish photogrpahs of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising and any other purpose and in amy manner and medium; to alter the same; and to copyright the same. The CLIENT hereby releases JBP and its legal representatives and assigns from all claims and liability relating to said photographs."
The photos were taken of my 8 month old daughter, and I thought JBP would be using them in a portfolio or on her website. Now the pictures are posted on someone else's business website, and I did not sign consent for that. Can I require that they be removed?

As a Franchise Attorney I can say this. Certainly your 8 month old daughter has a right of privacy, especially given her age. This aspect, including the entire contract you signed, as well as who was listed as "Client" and "Subject," need to be examined and analyzed. Consult with a good business or franchise attorney in your area for specific advice.
