Excused medical dismissal

I was fired from my job for missing 4 days in 6 months. All missed days are backed by medical excuses. 2 were used for wife having surgery. They are denying my unemployment. Do I have a recourse? Thank you.

Hello,

You do have a possible defense and chance to get unemployment. You would argue that you were not fired for misconduct because of the medical excuses. There are cases decided that provide for support for that. You would have to produce the excuses and a medical statement. An attorney would be of help in presenting your case, and an attorney by law cannot charge more than 10 per cent of the total amount benefits that you could recover. That is good for you, but if your amount is too small, it could make an attorney reluctant to help out. I can't give you a legal opinion or advice, however, without knowing more facts and doing an analysis. Thus, to find out for sure what your chances are, retain an attorney in your vicinity.
