Legal Question in Employment Law in Wisconsin

Non-Competitive Clause

I have a non-competitive agreement with my employer which states that I cannot work for a firm in the same industry anywhere in the United States for a period of one year. If I were to offered a job in the same capacity (as a buyer) with a competing firm, would this clause be enforceable?

Re: Non-Competitive Clause

The general law applicable to non-competition restrictions is that any such restriction must be "reasonable" in terms of time AND geography. The industry in which you are employed would be taken into consideration. However, since the law does not like to see a person totally prohibited from making a living, such restrictions may be voided if they are too broad. You should contact a Wisconsin attorney for a review of the document.
