eviction of a tenant

I have a tenant that is behind in her rent by two months.

i would like to know how long I have to give her to either pay or remove her things, and how I have to do it.

I am not a Wisconsin lawyer, and cannot advise on the specifics of Wisconsin law. However, this is one area where you probably want to retain an attorney to handle the matter for you. Landlord tenant law tends to be pretty picky about details, and trying to do an eviction on your own is an invitation to cast yourself upon the shoals of the technicality.

Your best bet would be to consult with a Wisconsin lawyer on the subject. Your state bar association probably has a lawyer referral service who can assist you with a referral to someone who practices in this area.

A reasonable fee in this kind of case is around $100 an hour. Lawyers routinely negotiate fees, and there are many who handle this kind of law. Insist that whomever you retain give you both an hourly rate and a fee cap, meaning an assurance that the fee will not exceed a certain sum. In that way you can protect yourself from a large fee. I assume that your lease provides for you to have the tenant pay any fees if you have to evict, so again, this is probably just good business. It's also deductible as a business expense.
