Return of Earnest Money

The potential landlord gave us a credit application to fill out and said he needed $600 to hold the apartment. 3 days after he told us we had the apartment we decided we could not afford it. We told him and he asked us to write a letter explaining why we could not longer take the apartment. He now refuses to return our $600 (- the agreed upon $40 for the credit check). He said he is keeping it for damages and lost income.
