My tenant is being held in custody for a domestic call at my home. His woman and child are still in the home. Do I have the right to refuse his return to the home? He is on the lease.

If you want to evict a tenant, you need grounds to do do and provide proper notice. Your post is far from clear on what grounds you might have under the lease.
