Legal Question in Legal Ethics in Wisconsin
A person went to the police department and filed a false report against me. An officer(who took the report) sent me a citation in the mail for $185.00 to pay. I'm mentally disabled, been harassed and abused by this person for a year living in residential living apartment. I believe it's because they got fired for their work conduct and myself exposing that. Were my rights violated? Thank you.

Ones rights are never any better than one's ability to assert or protect them in court. Therefore, unless your lawyer somehow asserts them in court properly, either in your defense at a trial or in some sort of other lawsuit, your rights are nearly certain to be violated. A better question than were my rights violated, would therefore be what can I do to protect my rights. In this case, that would be to have a trial, where the false charges would need to proven to a jury beyond any reasonable doubt, and after which trial you would theoretically be acquitted if any doubt remained as to your guilt. Your lawyer should ideally look for ways to discredit the person who made up the false charges against you. However, if you plead guilty or do not properly defend yourself, you are very likely to still be convicted on the false charges. My comments here are not legal advice, nor do they create an attorney client relationship between us. However, you always more than welcome to contact my office in Racine to discuss any additional questions which you may have or to set up a free consultation.
