Legal Question in Medical Malpractice in Wisconsin

Is there a time frame in which I would have to file a suit for medical malpratice in WI? There was many mistakes made and my husband passed away Nov 8, 2007. He was 49 years old went in for a hip replacement.

The general statute of limitations is 3 years from the malpractice event or 1 year from discovery, but generally not any longer than 5 years from event for discovery. The statute of limitations is three years from the date of injury. In your case, the date of injury would probably be the date of the surgery.
