Legal Question in Medical Malpractice in Wisconsin
Negligent administering of RhoGham after first pregnancy
With my first pregnancy I was identified as having a negative blood type whereas my baby had positive. To prevent RH sensitization, I was given a shot of RhoGham at week 28, and then again after I delivered. However, I later found out that I developed the RH sensitization anyway and have consequently suffered considerable doubt and concern over having another child.
During my first delivery, I learned that there were different levels of RhoGham that could be given after delivery depending on the woman's current blood levels. No test was ever done before OR AFTER I received the RhoGham. In addition, this same doctor refused to give me a pre-conception exam when I called and asked for one before we tried to get pregnant again. Even though she KNEW I was RH neg. Luckily, I found another doctor who insisted on a pre-conception exam and that is when we found our problem even existed.
My question is whether my first doctor was indeed negligent in not further researching my needed levels of RhoGham and also the other alternative treatments that may have prevented my current position. There were several other instances in her care where I doubted her integrity and if she is negligent, I want her stopped.

Re: Negligent administering of RhoGham after first pregnancy
The drug literature of the manufacturer of the drug recommends testing or screening for maternal fetal hemmorhage and if there is evidence of loss of the baby's blood cells into the maternal circulation in excess of a certain level that multiple doses of the drug be given. You should consult an attorney in your locale who can advise you of the laws and proceedures applicable in your state and whether pursuing a claim is practical.
