Legal Question in Medical Malpractice in Wisconsin
I am on a prescription for Parkinson's Disease. I was originally on 1mg 3 x's a day, but was having side effects from it, so the DR changed the dosage to 0.5 mg's 3 x's a day. (Works well). We have been going to a local pharmacy, but our insurance co. now requires that we do mail order. So, the mail order pharmacy requested new prescriptions from the Dr. When I rec'd the new drugs in the mail, I noticed that the wrong dosage was sent. We contacted the mail order drug co and they stated that the Dr's office sent in the wrong dosage. We contacted the Dr's office and the Dr said that was not good and could have caused a problem. Do we have any recourse?

In order to have a valid medical malpractice case, you must prove that you were injured by the doctor�s negligence. It does not seem that you were injured by the negligence, so you would not have a case you could pursue.
