Legal Question in Military Law in Wisconsin

Enlistment

Last Dec.our son thought he wanted to enlist in the Marines. After talking with his recruiter, we reluctantly signed a paper which we thought was just to have a physical and take a test. When he got home to our surprise he was enlisted inthe delayed entry program set to leave this coming July. our question is at the time he took the physical and test, he was and still is not 18. He now has changed his mind and does not want to enter the military. However the recruiter or anyone from the office in Janesville, WI will not return our calls since we told them he has changed his mind. His plans are to go to a technical college and take the same thing he signed up to do in the Marines. Can they legally make him go to boot camp in July. He has not been paid anything by the Marines.and he was only 17 (and still is) when he signed the papers himself for the delay entry program.

I beleive they are waiting to contact us until he is 18 which will be in May. But I want to make it clear we only thought we were giving permission for him to take a physical last Dec.

Dear Questioner,

There are procedures for you to withdraw consent. Additionally, while the services do not have to do so, the current policy appears to be that the services will honor requests to be removed from the DEP program. If the recruiter will not return your calls, trust me, he will return a call from an attorney or the attorney will go to his supervisor.

Where in Wisconsin are you? I have a good friend in the Sheboygen[sp]/Plymouth area who used to do a lot of military law. There is a bunch of paperwork that you have to do to "revoke" consent, etc. Let me know and I'll get you his name if he's at all close to you.
