Legal Question in Personal Injury in Wisconsin

auto accident injured passenger driver no insurance

I was driving in the car with a friend and we got in a one vehicle car accident. The police where never called but I had to go to the emergency room after and have been having a lot of back problems. I have been off work for a long time, collecting disability through work, and I half to go the chiropractor 2-3 times per week. My doctor bills and lost wages are about $8,000. My friend agreed to pay me $4,000 and I would pay the rest but now she refuses to pay me anything. Is there anything that I can do?

When you say you were driving, I must presume you were

riding, not driving. If your friend was negligent,

you would have rights against your friend and your

friend's insurer. Even if there is no insurance,

if you have under- or un-insured coverage yourself,

you may be able to proceed against your own company.

If you were driving, things would be different.

It sounds as though you have a claim that you should pursue. Did the driver have auto insurance? If not, did you have auto insurance? If there was insurance coverage, there should not be much of a problem recovering. If neither of you had insurance, then your only recourse would be to collect money from the driver. How much you could get would then depend upon what assets the driver has. Please call me if you would like to discuss this further.
