How long should it take for a settlement to be offered? convicted driver (DUI) hit a minor/ broken upper leg permenant pins/srews broken arm June 2006

An insurance company does not have any obligation to proactively offer settlement money to an injured person. The lawyer for the injured person usually determines when to make a settlement demand upon the insurance company. The prognosis for the injuries should be known before any attempt to settle the case is made, unless there is a low limit of liability insurance coverage so that settling for that amount right away would be better than waiting.

Your attorney should request all records bills, reports from your doctors, giving opinions as to the permanency of your injuries, as well as past wage loss, and a vocational analysis if a future earnings capacity loss is being claimed. Your attorney should then send in a settlment demand, often with a settlement brochure type of document. Most insurance companies should respond within 30-60 days to the demand. All offers should be conveyed to you for your review, consideration and discussion.
