Legal Question in Personal Injury in Wisconsin
Drank from a contaminated container at McDonald's
A few days ago, I ordered a meal (including drink) at McDonald's and didn't think anything of it. Today as I was cleaning my room, I came across the plastic drink container that my drink came in. There was still some liquid in there so I picked it up to dump out the liquid and throw away the container, but I immediately noticed that there was a piece of solid material in the drink. I dumped out the liquid and picked up the piece of plastic, and lo and behold it was some sort of nozzle that must have fell into my drink. I probably didn't notice it when I was drinking because of the ice cubes in the drink. I've read about how unsanitary these types of situations must be and am inquiring about legal action that could possibly be taken as I'm totally clueless about this kind of stuff.

It's hard to envision a claim like this moving forward. You may wish to call the Milwaukee Bar's Lawyer Referral Service at 414.274.1901 or Wisconsin Bar's Lawyer Referral Service at 800.362.9082.

In order to be able to successfully pursue a claim, you would have to be able to prove that McDonald's was negligent and that the negligence caused injury to you. From your description of the events, I do not think that you will be able to prove that you were injured. Thus, in my opinion, you do not have a claim that you could successfully pursue. Should you want to consider such a claim, the statute of limitations runs three years from the date of injury.
